July 2016: This action was voluntarily dismissed When a complaint is dismissed with prejudice, it cannot be refiled. as to the named plaintiff and When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled. as to the class members. The reasons for the dismissal have not been disclosed.
May 2016: A class-action lawsuit was filed against F. Gaviña & Sons, Inc. for allegedly deceptively marketing Don Francisco brand coffee. According to the complaint, the marketing for flavors of Don Francisco’s Gourmet Coffee – such as Vanilla Nut and Cinnamon Hazelnut – suggests that the coffee is flavored with natural ingredients without adequately disclosing that the coffees contain artificial flavoring. (Ely et al v. F. Gaviña & Sons, Inc., Case No. 16-cv-2694, N. D. CA.)
