Allegations: Falsely advertising discounts from artificially inflated reference prices
In May 2019, a class-action lawsuit was filed against Eddie Bauer for allegedly misleading consumers into believing they are getting a significant discount on merchandise sold at outlet stores when they’re not. The complaint claims that the store misleadingly represents that consumers are getting a significant percentage discount off of a false reference price when, according to the complaint, the merchandise is created exclusively for outlet stores and is never actually sold at the reference price.
