Costa Del Mar’s Warranties for Sunglasses
A class-action lawsuit was filed against Costa Del Mar for allegedly engaging in a bait-and-switch scheme. Specifically, the complaint alleges that the company deceptively advertises that its sunglasses are “backed for life” by a warranty with no “gimmicks” or disclaimers when, according to plaintiffs, purchasers are charged fees – including a “diagnostic” fee and shipping and handling – to repair or replace damaged sunglasses. The lawsuit was originally filed in October 2017 and transferred to federal court in November 2017. (Burden et al v. Costa Del Mar, Inc., Case No. 17-cv-3504, S.D. Tex.)
