The complaint, which was originally filed in February and amended in July, alleges that the company falsely labels its canned tomatoes as “Certified San Marzano” when, according to plaintiffs, the tomatoes are not San Marzano tomatoes and have not been certified by the Consortium of the San Marzano Tomato, the independent agency with the expertise and authority to certify tomatoes are San Marzano.
