Capital One’s Cash Advance Fees
Allegations: Representing that the credit card company charges Cash Advance Fees on cash loans or cash equivalents
June 2015: A federal judge granted final approval of a settlement of this lawsuit. According to the settlement terms, class members may receive a cash award of either $2 or $5.50. (The amount of the award depends on various factors, including whether the class member paid interest.) The settlement agreement also states that Capital One enhanced the disclosures in its 0% Offer materials, including those addressing the Grace-Period Effect and the Payment-Allocation Effect.
June 2014: A federal judge granted part of Capital One Bank’s motion for summary judgment and trimmed some of the class-action claims in this lawsuit. August 2013: A class-action lawsuit was filed against Capital One claiming the bank’s promotional materials offered customers 0% APR for 12 months on any amount they borrowed on their credit card using Access Checks when, in reality, these customers were charged the bank’s regular interest rate, even when they paid their purchase balance in full before the payment due date.
