In December 2018, a state court judge preliminarily approved a settlement agreement that would resolve a class-action lawsuit alleging that Canada Dry Ginger Ale is misleadingly marketed as “Made from Real Ginger” when, according to plaintiffs, the beverage actually contains ginger flavor extract and other flavors.
According to the settlement terms, class members may receive $0.40 for each product purchased. The minimum award for class members who file a valid claim form is $2 and the maximum award is $5.20 per household for class members who don’t have proof of purchase and $40 per household for class members who do have proof of purchase. In addition, the company agreed to stop using the label “Made from Real Ginger” on product labels but can continue to use the word “ginger” as long as it is with the words “taste,” “extract,” or “flavor.” A final fairness hearing is April 10, 2019.
