October 2020: This case was voluntarily dismissed When a complaint is dismissed with prejudice, it cannot be refiled. because the parties reached a settlement agreement, the terms of which have not been disclosed.
July 2020: The case was transferred from a court in New York to one in Florida. (Case No. 20-cv-331, M.D. Fla.)
June 2020: A federal judge dismissed several of the claims – including the breach of warranty claims – but the false advertising claims will move forward.
January 2020: A class-action lawsuit was filed against The Cookware Company for allegedly falsely advertising that “nothing sticks to Blue Diamond’s nonstick ceramic surface” on Blue Diamond Enhanced Ceramic Non-Stick Pans when, according to plaintiffs, the cookware does not perform as advertised. (Lamb et al v. The Cookware Company (USA), LLC, Case No. 20-cv-704, S.D.N.Y.)
