In July 2015, a false advertising class-action lawsuit against Johnson & Johnson was dismissed When a complaint is dismissed with prejudice, it cannot be refiled. after the parties reached a settlement (the terms of which have not yet been disclosed). Among other things, the 2011 complaint alleged that the company:
- Marketed Benecol® spreads as proven to reduce cholesterol without meeting the minimum requirements to make such claims; and
- Misrepresented that Benecol® spreads contain no trans fat and no trans fatty acids when they actually do.
