April 2013: A false advertising class-action lawsuit was filed against CPG International and AZEK Building Products for allegedly falsely advertising synthetic decking and railing products made of polyvinylchloride (PVC). Specifically, the complaint, which was amended in October 2013, alleges that the companies advertise PVC products as “stain resistant,” “scratch resistant,” and “designed to last beautifully” when, according to plaintiffs, they prematurely discolor, crack, stain, and deteriorate under normal conditions. (Glodo et al v. CPG International, Inc. and AZEK Building Products, Inc., Case No. 13-cv-00402, S.D. Ill.).
