July 2019: The claims of one of the named plaintiffs (Kubilius) were voluntarily dismissed When a complaint is dismissed with prejudice, it cannot be refiled., the reasons for which have not been disclosed. The claims of the other two named plaintiffs (Kailey and Van Peebles) remain pending.

October 2018: A class-action lawsuit was filed against Arizona Beverage Co. for allegedly misleadingly marketing its beverages as having “No Preservatives” when, according to the complaint, the beverages contain preservatives, such as citric acid and ascorbic acid. (Kubilius et al v. Arizona Beverage Company LLC, Case No. 18-cv-9075, S. D. NY.)
