360-Degree Camera Systems in Ford Vehicles
Allegations: Marketing that the 360-degree camera system is a safety feature in vehicles when the system routinely malfunctions and does not work as advertised due to a defect
July 2014: This action was voluntarily dismissed When a complaint is dismissed with prejudice, it cannot be refiled. because the parties reached a settlement agreement, the terms of which have not been disclosed.
2013: A class-action lawsuit filed against Ford Motor Company in 2013 for allegedly making misrepresentations about the 2013 Ford Escape SE has been given the green light to continue on. Consumers allege that Ford misrepresented that the Escape SE will achieve 30 miles per gallon on the highway when, according to plaintiffs, the vehicle achieves 25-26 miles per gallon on the highway. Ford tried to get the case thrown out by arguing, among other things, that the lawsuit is preempted by federal law (i.e., that certain federal laws prevent plaintiffs from suing Ford based on the allegations in their complaint). In February 2014, a federal judge disagreed with the company’s arguments and denied the company’s motion to dismiss. (Gilles et al v. Ford Motor Company, Case No. 13-cv-00357, D. CO.).
