May 2019: A federal judge granted final approval of the settlement agreement.
January 2019: A federal judge granted preliminary approval of a settlement agreement that would provide class members with a cash award drawn from a $1.3 million settlement fund after attorneys’ fees, a service award to the named plaintiff, and other administrative costs are paid. The amount class members receive will depend on whether they have proof of purchase and the number of products purchased. Metagenics stopped selling the products named in the complaint and discontinued or re-labelled other similar products after this lawsuit was filed. A final fairness hearing is scheduled for May 6, 2019.
2018: Plaintiffs filed an amended complaint making similar allegations.
2015: A class-action lawsuit was filed against Metagenics, Inc. for allegedly misleadingly marketing UltraMeal Plus 360 and other similar products as “medical foods” that will treat a variety of health conditions – including cardiovascular disease and metabolic syndrome – when, according to plaintiffs, the products are actually ordinary foods and dietary supplements that are available to all consumers on the internet.
