February 2017: This case was consolidated with another similar lawsuit, Bledsoe v. FCA US LLC and Cummins Inc. (Case No. 16-cv-14024, E. D. MI.) Click here to learn more about the status of the case.

December 2016: A class-action lawsuit was filed against Chrysler Group and Cummins Inc. regarding the marketing of vehicles with Cummins diesel engines, including the Dodge Ram 2500 and Dodge Ram 3500. Specifically, the complaint alleges that the companies market the vehicles as having the “cleanest” engine and meeting the EPA’s clean diesel standards when, according to plaintiffs, the vehicles have defeat devices (i.e., devices that reduce the effectiveness of emission control systems under normal driving conditions) to ensure the vehicles pass emissions testing and emit more nitrogen oxides (NOx) than legal limits allow during normal driving conditions. (Perdue et al v. FCA US LLC f/k/a Chrysler Group LLC and Cummins Inc., Case No. 16-cv-14461, E. D. MI.)
