Allegations: Falsely marketing products as covered in yogurt
October 2015: This case was stayed pending the outcome of related cases in the Ninth Circuit Court of Appeals and the U.S. Supreme Court.
March 2014: A federal judge allowed a class-action lawsuit against Welch Foods to continue. The complaint, which was originally filed in 2012, alleges that, among other things, the company misleadingly labels products. Specifically, plaintiffs claim that the company misleadingly labels 100% Juices as having “no sugar added” when the juices actually contain sugar and without adequately disclosing that the juices are not low in calories, as required by federal regulations. In addition, plaintiffs claim that the company misleadingly labels Natural Spreads as “all natural” when they actually contain artificial flavors, colors, and preservatives. (Park et al v. Welch Foods Inc., Case No. 12-cv-06449, N.D. Cal.).
