November 2014: A federal judge suspended a class-action lawsuit filed against Wallaby Yogurt in 2013 over its allegedly deceptive use of the term “evaporated cane juice” as an ingredient in its organic low fat and non-fat blended yogurts. The action was suspended pending the FDA’s determination of when the term “evaporated cane juice” may be appropriately used. (Morgan et al v. Wallaby Yogurt Company, Inc., Case No. 13-cv-00296, N. D.
