In December 2018, a class-action lawsuit was filed against Tropicana for allegedly deceptively marketing that the “essential” probiotics in its Essentials Probiotics fruit juices provide health and nutrition benefits without having adequate scientific evidence to support such claims. According to the complaint, the marketing also implies that authorities have established a minimum nutrient level for probiotics when such claims are not true. Plaintiffs also claim that the drinks contain “almost as much sugar as a can of Pepsi” and “irrationally contain substances that naturally occur in dairy products, to fruit juices.” (Bowman et al v. Tropicana Products, Inc., Case No. 18-cv-7251, E. D. NY.)
