May 2016: This action was voluntarily dismissed When a complaint is dismissed with prejudice, it cannot be refiled. as to the named plaintiff and When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled. as to the putative class members. The reasons for the dismissal have not been disclosed.
March 2015: The plaintiffs filed an amended complaint, narrowing their claims but still alleging that Fifth Dimension falsely markets Tito’s handmade Vodka as “handmade.”
September 2014: A class-action lawsuit was filed against Fifth Dimension (and transferred to federal court in October) for allegedly falsely marketing Tito’s Handmade Vodka as handmade when it is actually machine-made. (Hofmann et al v. Fifth Generation and Does 1-100, Case No. 14-cv-02569, S. D. CA.).
