January 2022: The appellate court affirmed the district court’s decision. (Case No. 20-3831, 2nd Cir.)

November 2020: Plaintiffs filed a Notice of Appeal regarding the dismissal order.

October 2020: The Court adopted the Report and Recommendation and dismissed the case.

September 2020: The magistrate judge recommended that the Court grant the defendant’s motion to dismiss.

June 2020: This case was transferred from state court to federal court. (Case No. 20-cv-736, W.D.N.Y.)

April 2019: A class-action lawsuit was filed against Wall & Associates for allegedly falsely advertising its tax relief services by deceiving consumers about the location of its offices and misrepresenting the cost and duration of its services, as well as the experience and qualifications of its employees. Among other things, plaintiffs claim that:

  • The company misrepresents that it has offices and locations around the country when, according to the complaint, the company performs work out of its permanent offices in Virginia and Tennessee and only rents “local offices” for appointments with consumers;
  • The company tells consumers they are meeting with tax consultants and tax experts to get tax advice when, according to the complaint, consumers are actually meeting with salespeople who have little to no tax-related work experience or education and the salespeople do not give consumers tax advice; and
  • Salespeople encourage and pressure consumers to sign up without evaluating if they need and can afford to pay for services.
