
Sparkling Ice Told Its Water Is Not that Bold
Self-regulatory body refers Talking Rain’s advertising claims to the FTC.
In November 2018, a class-action lawsuit was filed against Talking Rain Beverage Company for allegedly misleadingly marketing its Sparkling Ice fruit-flavored beverages – including Sparkling Black Raspberry, Sparkling Ice Peach Nectarine, and Sparkling Ice Crisp Apple – as being flavored with only natural ingredients when, according to the plaintiffs, the beverages contain an artificial flavor malic acid. (Augustine et al v. Talking Rain Beverage Company, Inc., Case No. 18-cv-2576, S.D. Cal.)
