June 2014: The Scotts Miracle-Gro Company and The Scotts Company, LLC moved to dismiss a class-action lawsuit alleging that the companies falsely market Scotts Lawn Fertilizer Plus 5.17% Iron (“GreenMax). The companies argue that the court does not have subject matter jurisdiction and the complaint does not state a claim upon which relief can be granted. Among other things, the complaint – which was originally filed in April 2014 – alleges that the product’s packaging includes directions to prevent rust stains on hard surfaces when, according to plaintiffs, the fertilizer causes rust stains even if consumers follow these directions.
