June 2019: Plaintiffs filed an amended complaint similarly alleging that SanDisk USB Flash Drives have fewer GBs of memory than advertised. The amended complaint brings both false advertising and breach of contract claims.

May 2019: A federal judge dismissed the false advertising claims brought against SanDisk When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled. concluding that plaintiffs failed to properly allege that the product packaging is misleading. In addition, the breach of contract claims were dismissed When a complaint is dismissed with prejudice, it cannot be refiled. because the judge determined that the company provided what it promised on the packaging.

2018: A false advertising class-action lawsuit was filed against SanDisk alleging that its USB Flash Drives have less storage space than advertised. For example, plaintiffs claim that flash drives advertised as having 4 GBs of storage space actually have 3.73 GBs of space and flash drives advertised as having 256 GBs of storage space actually 238.42 GBs of space.
