
Room Rates at Omni Hotels
December 2020: A federal judge dismissed the case When a complaint is dismissed with prejudice, it cannot be refiled. concluding that reasonable consumers would not be deceived because the hotel discloses that the advertised room rate does not include taxes and fees, includes details about the taxes and fees added to the advertised price in drop-down menus, and tells consumers the total cost of a room before they click “Reserve” to book a room.
October 2020: An amended complaint was filed adding allegations that the named plaintiff was looking for hotel rooms on Expedia, which is where Omni allegedly deceptively marketed its hotel rooms.
September 2020: This case was transferred from state court to federal court. (Case No. 20-cv-1777, S.D. Cal.)
July 2020: A class-action lawsuit was filed against Omni Hotels and Resorts for allegedly engaging in drip pricing. Specifically, plaintiffs claim that the hotel advertises a low base rate for hotel rooms without disclosing that consumers end up paying more than the advertised rate for rooms because they are charged additional fees in addition to the base rate.
