A class-action lawsuit was filed against B&G Foods and Pirate Brands for allegedly deceptively using You know when you buy a big bag of chips, and you’re all psyched for a feast, and then it turns out there are like, three chips in the bag? That bag is slack filled.ed packaging. Specifically, the complaint alleges that the opaque packaging for Pirate’s Booty Aged White Cheddar snacks contain 44.44% empty space. The lawsuit was originally filed in June 2017 and transferred to federal court later in June. Then, the lawsuit was remanded back to state court in July 2017. (Greenstein et al v. B&G Foods, Inc. and Pirate Brands, LLC, Case No. 17-cv-4839, C. D. CA.)
