
Horizon Organic Milks with DHA Omega-3
In August 2017, a class-action lawsuit was filed against WhiteWave Foods Company for allegedly falsely marketing that milks containing DHA Omega-3 support brain health when, according to plaintiffs, the milks do not provide the represented health benefits. According to the complaint, the milks cannot “meaningfully contribute to brain structure, function or health” because the amount of DHA in the milks is “trivial” and DHA supplementation is “superfluous” and “unneeded” because consumers get enough DHA from their daily diets. (Zeiger et al v. WhiteWave Foods Company, Case No. 17-cv-4464, N. D. CA.)
