TINA.org Takes Action against Trademark Imposter Scam
Complaint to FTC cites violations of agency’s Impersonation Rule.
A false advertising class-action lawsuit was filed against Herb Thyme Farms, a California herb-growing company, alleging that it falsely labels herbs as “Fresh Organic” when, according to plaintiffs, some of the packages contain herbs that are not organic. The complaint, which was originally filed in 2010, was amended in January 2017 after the Supreme Court of California reversed a Court of Appeals judgment and remanded the case for further proceedings.
