At issue is company’s distribution of products illegally marketed as drugs.
In September 2014, a class-action complaint was filed against Fumizer for, among other things, allegedly marketing e-cigarettes as providing “healthy smoking” when, in reality, medical studies show that the e-cigarettes contain carcinogens, toxins, and other harmful chemicals. The complaint also alleges that the company misleadingly claims the e-cigarette can “help you quit smoking” when other marketing materials actually disclaim any use to help a smoker quit smoking. (Sheppard v. Fumizer LLC, Case No. BC558408, Superior Court of California, County of Los Angeles).
