August 2014: A federal judge granted in part and denied in part Frito-Lay’s motion to dismiss. The judge dismissed the “natural” claims finding that they were conclusory and did not plead why and how ingredients were unnatural. The judge also dismissed “fat free” and “low fat” claims finding that they were implausible because reasonable consumers would not interpret “fat free” claims as also communicating that products are low in sodium and healthful. The judge gave plaintiffs 30 days to file an amended complaint.
August 2013: A class-action lawsuit was filed against Frito-Lay for allegedly mislabeling its pretzel products as “All Natural” when, according to plaintiffs, the pretzels contain artificial ingredients. In addition, plaintiffs claim that these pretzels are labeled as “low fat” or “fat free” when the products are not because they contain too much sodium. (Figy et al. v. Frito-Lay North America, Inc., Case No. 13-cv-03988, N. D. CA.).
