February 2013: A class-action lawsuit was filed against Boulder Brands, Inc. (formerly Smart Balance, Inc.) and its subsidiary for deceptively marketing its “Fat Free” enhanced milks. Specifically, the complaint alleges that companies market the milks as fat free when, according to plaintiffs, the milks contained 1 gram of fat per serving until September 2012. (Koenig et al. v. Boulder Brands, Inc. et al., Case No. 13-cv-01186, S.D.N.Y.)
