Allegations: Falsely advertising discounts off of artificially inflated “original” prices
In October 2017, a class-action lawsuit was filed against The Gap and Banana Republic for allegedly deceptively advertising discounts on apparel by misleadingly comparing lower discounted prices to fake original prices when, according to the complaint, items are never offered for sale at the fake original prices. The lawsuit was transferred to federal court in November 2017. (Coladonato et al v. The Gap, Inc.
