Discounted Prices at Van Heusen
September 2020: A federal judge dismissed the complaint concluding that the named plaintiff failed to meet the heightened pleading standard for fraud-based claims and failed to allege that he was injured by the store’s false discount pricing.
December 2019: A class-action lawsuit was filed against PVH Corp. for allegedly displaying a false reference price on merchandise at Van Heusen stores in New Jersey to make consumers think they are getting items at a discounted price when, according to plaintiffs, the reference price is not a price at which the items were ever sold. (DiCicco et al v. PVH Corp., Case No. 19-cv-11092, S.D.N.Y.)
