In October 2017, a class-action lawsuit was filed against Coca-Cola for allegedly making consumers believe that Diet Coke will assist weight loss and management by misleadingly marketing the soda as “diet” when, according to the complaint, the soda contains an artificial sweetener (aspartame) and scientific evidence shows that artificial sweeteners lead to weight gain and increase the risk metabolic disease, diabetes, and cardiovascular disease. (Geffner et al v. The Coca-Cola Company, Case No. 17-cv-7952, S. D. NY.)
