July 2017: The First Circuit Court of Appeals affirmed the district court’s decision to dismiss this false advertising lawsuit against Nordstrom.

August 2015: A federal judge granted the store’s motion to dismiss finding, among other things, that the complaint did not adequately allege injury.

December 2014:
A false advertising class-action lawsuit was filed against Nordstrom Rack for allegedly deceptively advertising pricing discounts. The complaint, which was transferred from state court to federal court in February 2015, alleged that the store misleadingly offers discounts off of false former prices (i.e., “Compare At” prices) that were overstated and did not represent the prevailing retail market price within the three months immediately before the advertisement, as required by Massachusetts law.
