Lawsuit alleges sandwich chain misleadingly markets 'unlimited' drinks subscription.
Consumers who signed up for Panera’s Unlimited Sip Club earlier this year may now find that the subscription service isn’t quite quenching their summer thirst due to a restriction that limits fill-ups to once every two hours.
A Michigan man is suing Panera alleging the sandwich chain misleadingly markets that subscriptions allow members to get an unlimited number of drinks and refills without adequately disclosing the drinks are actually limited to one every two hours and “while you’re in the cafe.”
The class-action lawsuit also claims Panera entices consumers to sign up for subscriptions by offering a one-month “free trial.” However, when consumers attempt to make use of the offer, “they are immediately charged the monthly fee for their first month,” the lawsuit states.
The monthly fee for an Unlimited Sip Club subscription is $10.99 plus tax.
