March 2018: Plaintiffs filed an amendment to the settlement agreement. The amended agreement gave class members more time to redeem their credits (18 months instead of 12) and a cash payment if they did not use all of their credits. The amended agreement also deferred the request for attorneys’ fees until the end of the redemption period to give the Court a chance to consider the settlement agreement’s actual benefit to the class.

November 2017: The parties revised the settlement agreement and agreed to lower the attorneys’ fees, change the Verification Form deadline, and mail postcards to class members. Later in November, a federal judge preliminarily approved the revised settlement. A final fairness hearing is scheduled for March 19, 2018.

June 2017: The parties moved for preliminary approval of a settlement agreement that would provide class members with credits ranging from $0.50 to $2.25 to use toward future purchases. The proposed agreement also states that the website at issue replaced the term “Original Price” with “Comparable Price” and included a definition of “Comparable Price.”

March 2016: A class-action lawsuit was filed against Wines ‘Til Sold Out for allegedly misrepresenting the existence, nature, and amount of price discounts on its website by offering specific percentage discounts from original prices that never existed and were not the prevailing market price for the product.
