April 2019: This case was voluntarily dismissed When a complaint is dismissed with prejudice, it cannot be refiled. because the parties reached a settlement agreement, the terms of which have not been disclosed.

September 2017: Instead of granting the company’s motion to dismiss, the Court stayed this case pending the FDA’s decision regarding the proper use of the word “natural.”

October 2016: A class-action lawsuit was filed against Topco for allegedly misleadingly marketing its Granola Oats, Honey & Almonds as 100% natural when, according to plaintiffs, it actually contains a harmful chemical ingredient, glyphosate. (Scholder et al v. Topco Holdings, Inc. and Topco Associates, LLC, Case No. 16-cv-6028, E.D.N.Y.)
