Allegations: Misleadingly using slack-filled containers
In August 2019, a class-action lawsuit was filed against Glanbia Performance Nutrition for allegedly misleadingly marketing that the flavoring ingredient in ThinkThin and Think! oatmeal cups and packets is vanilla beans when, according to plaintiffs, the ingredients list shows that the products contain more “Natural Flavors” than vanilla beans. Plaintiffs also allege that the ground vanilla beans in the products are likely exhausted vanilla beans that do not add any flavor. (Haut et al v. Glanbia Performance Nutrition (Manufacturing), Inc., Case No. 19-cv-4566, E.D.N.Y.)
