August 2012: A class-action was filed against Johnson & Johnson and McNeil Nutritional alleging that the companies falsely advertise Splenda Essentials as a no-calorie sugar substitute that “gives you a small boost of healthy nutrients” when, according to plaintiffs, the sweeteners do not provide such benefits. The complaint claims that defendants “bombard consumers with a message of purported health, and draw consumer attention away from the differences between artificially added nutrients and those found in whole foods.” (Plaintiffs filed an amended complaint in April 2013.)
