Allegations: Failing to include a “U.S. Music Royalty Fee” in advertised prices

June 2020: Plaintiffs filed an Amended Consolidated Class Action Complaint and moved for preliminary approval of a proposed settlement agreement. According to the settlement terms, class members with active lifetime subscriptions may transfer Sirius XM to another device an unlimited number of times for a $35 fee while class members with inactive lifetime subscriptions may reactivate their subscription or receive $100 for each inactive subscription. The agreement would also make the Sirius XM internet streaming service available to class members who reactivate their inactive subscriptions.
October 2018: This case was transferred from state court to federal court. (Case No. 18-cv-8605, C.D. Cal.)
August 2018: A class-action lawsuit was filed against Sirius XM Radio for allegedly deceptively advertising that lifetime subscriptions last for the lifetime of the purchaser when, according to the complaint, the subscriptions actually last for the lifetime of the purchaser’s radio receiver or vehicle. (Alvarez et al v. Sirius XM Radio Inc., Case No. BC719411, California State Court – Los Angeles)
