In October 2014, a false advertising class-action lawsuit filed against The Kroger Co. in February over its marketing of Simple Truth chicken was voluntarily dismissed. The complaint alleged that the company deceptively markets the chicken as being raised “cage free in a humane environment” when, in fact, the chickens are not treated differently than other mass-produced chickens on the market. The plaintiffs dropped their lawsuit because the company agreed to remove the “raised in a humane environment” language from the label. (Ortega et al v. The Kroger Co., Case No. 14-cv-01949, C. D. CA.).
