Allegations: Misleadingly advertising that products contain white chocolate
In February 2019, a class-action lawsuit was filed against Russell Stover Chocolates and Ghirardelli Chocolate Company alleging that packages of their chocolates are “predominately empty.” According to the complaint, the companies make consumers believe that packages contain more chocolates than they actually do because the empty space is not visible to consumers. Plaintiffs also claim that the packaging misstates the weight and height of the product inside. (Faison et al v. Russell Stover Chocolates LLC and Ghirardelli Chocolate Company, Case No. 19-cv-721, E. D. NY.)
