Why disclosures are key to protecting informed consumer choice and competition.
In October 2019, a class-action lawsuit was filed against Newell Brands and NUK USA for allegedly misleadingly marketing that NUK® Orthodontic Pacifiers promote healthy oral development in children and improve their dental health by correcting the position of teeth and jaws when, according to plaintiffs, the pacifiers do not provide the advertised dental health benefits. The complaint also claims that the marketing falsely represents that the pacifiers are safe for children 24 months and older without adequately disclosing the risks associated with using the pacifiers. (Benson et al v. Newell Brands Inc. and NUK USA LLC, Case No. 19-cv-6836, N. D. IL.)
