August 2014: This action was voluntarily dismissed When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled.. The reasons for the dismissal have not been disclosed.

July 2014: A class-action lawsuit was filed against Wellness and Health, LLC for allegedly deceptively marketing its Max Detox pills, a weight-loss dietary supplement. Plaintiffs claim that the company misleadingly advertises the weight-loss supplement in a number of ways, including:

  • Representing that consumers who use Max Detox will lose a substantial amount of weight without adequate support to make such claims,
  • Offering consumers a 15-day free trial when, in reality, they must cancel the trial within 15 days of placing the order to avoid being charged the full price, and
  • Representing that there are “no commitments” to the trial when, in reality, the company enrolls consumers in an auto-shipment program (where consumers must pay for monthly supplies of the product).
