January 2018: A class-action lawsuit was filed against J&J Snack Foods for allegedly underfilling Luigi’s Real Italian Ice. Specifically, the complaint alleges that the cups advertised as containing six fluid ounces only contain an average of only 5.4- to 5.5-fluid ounces. (Orbach et al v. J&J Snack Foods Corp., Case No. 18-cv-321, S.D.N.Y.)
