April 2017: The remaining five appeals (Carey, Foligno, Hipshire, Mager, and Vullings) were dismissed.

February 2017: Three more of the appeals (Amaya, Gallagher, and Holcomb) were dismissed. Other appeals are still pending.

September – November 2016: Four of the appeals (Sweeney, Ference, Harrington, and Cassidy) were dismissed. Other objector appeals are still pending.

July 2016: A federal judge granted final approval of a settlement of this action. According to the settlement terms, class members may choose to receive a cash award or a voucher to use toward a future purchase at Justice stores. The amount of the award varies substantially and is based on the number and amount of the class member’s purchases, as well as the type of recovery allowed in the class member’s home state.

September 2015: Plaintiffs filed an amended complaint adding additional named plaintiffs and making the same allegations.

February 2015: class-action lawsuit was filed alleging that Justice stores, a seller of children’s clothing and fashion apparel, deceptively advertises discounts when the prices were never actually discounted. Specifically, the complaint alleges that the advertised discounts never ended and, as a result, the prices were always the same. (Mehigan et al v. Ascena Retail Group, Inc., d/b/a Justice Stores and Tween Brands, Inc., d/b/a Justice Stores, Case No. 15-cv-00724, E. D. PA.).
