Five Brand Names to Beware of this April Fools’ Day
Oh, the irony behind these five brand names.
In February 2015, a class-action lawsuit was filed against Hampton Creek, Inc. for allegedly deceptively marketing its Just Mayo sandwich spread products. Specifically, plaintiffs claim that the company misleadingly represents that Just Mayo is mayonnaise when, in reality, it is not. According to the complaint, federal regulations and dictionaries define “mayonnaise” as a product that contains eggs and there are no eggs in Just Mayo. Later the same month, the action was voluntarily dismissed after the Court ordered the named plaintiff to demonstrate why the case should not be dismissed for lack of subject matter jurisdiction. (Davis et al v. Hampton Creek, Inc., Case No. 15-cv-20440, S. D. FL.).
