In October 2014, a false advertising class-action lawsuit against Whitewave Foods Company was dismissed without prejudice (meaning that plaintiffs can refile their lawsuit at a later date). The complaint, which was originally filed in August 2014, alleged that the company misleadingly advertises that its DHA-fortified milk – including Horizon Organic Whole Milk plus DHA Omega-3, Horizon Organic Chocolate Milk plus DHA Omega-3, and Silk DHA Omega-3 & Calcium All Natural Soy Milk — will support brain health in children and adults without scientific evidence to support such claims. We cannot determine why the parties agreed to dismiss the lawsuit. The lawsuit was dismissed without prejudice, meaning that plaintiffs can refile the complaint. (Krinsk et al v. Whitewave Foods Company, The Vons Companies, Inc., Safeway Inc., and Does 1-50, Case No. 14-cv-01984, S. D. CA.).
