May 2017: This action was voluntarily dismissed because the parties reached a settlement agreement, the terms of which have not been disclosed. The dismissal was When a complaint is dismissed with prejudice, it cannot be refiled. as to the named plaintiff and When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled. as to the class members’ claims.

May 2016: A class-action lawsuit was filed against Harbor Freight Tools USA (a tool and equipment retailer) for allegedly deceptively advertising sales by comparing “sale” prices to artificially inflated regular prices. According to the complaint, the represented “regular” prices were never the regular retail prices of the items and not the prevailing market retail prices within the three months immediately before the advertisement, as required by California law. (Shimono et al v. Harbor Freight Tools USA, Inc., Case No. 16-cv-1052, C. D. CA.)
