December 2018: The Ninth Circuit Court of Appeals reversed the district court’s decision to grant summary judgment and remanded the case for further proceedings. Click here to read the decision. (Case No. 17-5261, 9th Cir.)
February 2017: The district court granted the companies’ motion for summary judgment finding that plaintiff did not establish that she relied on the alleged misrepresentations and that she did not demonstrate that defendants misled customers. To read the court order and learn more about the reasons for the decision, click here. Later in February, the named plaintiff filed a Notice of Appeal regarding the order granting summary judgment.
July 2015: A false advertising class-action lawsuit was filed against Schwabe North America, Inc. and Nature’s Way Products, LLC. The complaint alleges that the companies falsely advertise Ginkgold® products – including Advanced Ginkgo Extract and Max Advanced Ginkgo Extract Max 120 mg – as able to improve memory and concentration, support mental sharpness, and support healthy brain activity when, according to the plaintiffs, the products do not work as advertised. (Sonner et al v. Schwabe North America, Inc. and Nature’s Way Products, LLC, Case No. 15-cv-1358, C.D. Cal.)
