September 2018: This action was voluntarily dismissed When a complaint is dismissed with prejudice, it cannot be refiled. as to the named plaintiff’s claims and When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled. as to the class members’ claims. The reasons for the dismissal have not been disclosed.
July/August 2018: This case was transferred from state court to federal court. (Case No. 18-cv-4965, N. D. IL.)
June 2018: A class-action lawsuit was filed against VitaJuwel for allegedly falsely advertising the effects GemWater bottles (bottles with various stones in smaller, airtight containers inside of them) have on water poured into them. Specifically, the complaint alleges that the marketing claims that the water bottles increase the pH of water from 7.87 to 8.02 and increase the dissolved oxygen from 9.90% to 10.04% when, according to plaintiffs, such claims are not true and the company does not have a scientific basis for making the claims. (Ashkinazi et al v. VitaJuwel USA, Inc., Case No. 2018-CH-07777, Circuit Court of Cook County, Illinois)
