July 2018: This case was transferred from a court in Florida to a court in Ohio. (Case No. 18-cv-464, S.D. Ohio)
March 2018: A class-action lawsuit was filed against Fifth Third Bank for allegedly failing to disclose that customers are charged two, and sometimes three, out-of-network fees on transactions on ATMs that are not owned by Fifth Third Bank or one of its partners. According to the complaint, customers who check their account balance before withdrawing funds are charged a fee for the balance inquiry, another for the withdrawal, and sometimes a fee to use the ATM that goes to its operator. Plaintiffs also claim that the bank represents that it charges an international transaction fee on the amount of transactions made in a foreign currency when, according to the complaint, the bank charges such fees on transactions made in U.S. dollars and the amount of the transaction includes the fee charged by the ATM operator. (Smith v. Fifth Third Bank, Case No. 18-cv-464, M.D. Fla.)
